How to title a mobile home in Kansas
Kansas titles manufactured homes through the Department of Revenue, with the county treasurer checking the application; a buyer has 30 days to apply and a title costs $10. A home on a permanent foundation can have its title eliminated with Form TR-63 and a $10 fee.
Who titles the home
Manufactured and mobile homes are not subject to the vehicle titling and registration statutes in chapter 8, article 1.
The Kansas Department of Revenue says homes not affixed to land must be titled under K.S.A. 58-4204.
The county treasurer checks that the facts in the title application are true.
The Department of Revenue's title form for these homes is TR-212b, the Manufactured or Mobile Home Title and Registration Manual Application.
An original certificate of title costs $10.

Transferring ownership
After a sale or transfer, the new owner must apply for a new title within 30 days, counting weekends and holidays.
To transfer a home, the seller assigns the title (or the MSO for a new home) to the buyer.
A mobile or manufactured home cannot be sold on a bill of sale in Kansas.
A seller without a title must obtain one before transferring ownership.
No new title is issued while a lien is unreleased unless the lienholder consents to the transfer in writing.
A new title is issued to the buyer for a $10 fee.
Owners of homes with a model year of 1979 or older that have no Kansas title record may prove ownership with Form TR-64 and proof of the preceding 5 years of property taxes.
New homes pay sales tax on 60 percent of the purchase price; used homes are exempt.

Taxes and the move
For property tax, a mobile or manufactured home is personal property unless, among other conditions, its owner or the owner's spouse also holds title to the land it sits on.
Homes used as residences are valued at fair market value as of January 1 and assessed at 11.5%.
The owner must list the home for property tax with the county appraiser where it is located.
If assessed personal property is about to leave the county before its taxes are paid, the tax becomes due and payable at once.
The county clerk or assessor must be notified of any mobile or manufactured home moved onto a park or land from outside the county between January 1 and July 1.

Homes on land (real property)
A home is treated as an improvement to real property once its certificate of title is eliminated under K.S.A. 58-4214.
Form TR-63 needs a county official's signature stating whether the home has a permanently affixed foundation.
The TR-63 application must include the most recent personal property and real estate tax receipts as proof of payment.
The TR-63 application goes to the Kansas Department of Revenue with a $10 fee.
The title is not eliminated until the approved affidavit is recorded at the county register of deeds.
For property tax, a home can be treated as real property without eliminating its title.

Taxes before the move
Ask the county treasurer where the home sits now whether taxes must be paid or a permit obtained before it leaves, and how to restore an eliminated title before a move.
